Terms of Service

These Terms of Service (“Terms”) are a contract between you and Freedom Empowering Capital Management LLC (“Affiliateking AI,” “we,” “us,” or “our”) for use of https://affiliatekingai.com, https://www.affiliatekingai.com, and the Affiliateking AI software (the “Service”).

By creating an account, checking the agreement box at registration, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract. The Service is offered from the United States. You are responsible for complying with laws that apply to you.

2. The Service (what we provide)

Affiliateking AI is software that can help you:

  • Complete niche intake and receive affiliate program recommendations
  • Generate draft SEO affiliate sites and articles (intended for hostnames such as *.affiliatekingai.com when publishing is available)
  • Draft creatives and view performance / optimization recommendations
  • On higher plans, connect certain affiliate network APIs when those connectors work

Important limits

  • Starter plans use demo / simulated campaign data and do not connect to live affiliate network APIs.
  • Pro and Elite plans include live network connections (Amazon, Impact, ShareASale, CJ, as described on pricing) when you connect your own accounts. Live metrics apply once your accounts are successfully connected.
  • A suggested customer hostname (*.affiliatekingai.com) is not live until it resolves and serves your site.
  • We are a tool vendor, not your co-publisher, agency, lawyer, or financial advisor.

3. Accounts

  • Keep your login credentials confidential. You are responsible for activity under your account.
  • Provide accurate registration information.
  • Notify us promptly of unauthorized access at freedomempowering1@yahoo.com.
  • One person or entity per account unless we agree otherwise in writing. Do not share logins in a way that evades plan limits.
  • We may suspend or terminate accounts that violate these Terms or create security or legal risk.

4. Plans, billing, and cancellation

Plans. We currently describe three paid tiers (prices as shown on /pricing, which may change):

  • Starter — practice workflow with demo/simulated data
  • Pro — live network connections and metrics (when connected)
  • Elite — higher limits, advanced features, and dedicated support via in-app chat as described on pricing

Billing. Paid subscriptions are billed through Stripe. By subscribing you authorize recurring charges for your selected plan until you cancel. Taxes may apply.

Cancel anytime. You may cancel your subscription at any time from in-app Settings or via the Stripe customer portal. After you cancel, you keep access through the end of the then-current paid period. Access ends when that period ends, unless we are required by law to end it sooner.

Refunds. Fees are non-refundable except where required by law. Contact freedomempowering1@yahoo.com with billing questions.

Price changes. We may change prices with notice. Changes apply on the next renewal unless you cancel.

Failed payments. If payment fails, we may retry, downgrade, or suspend access until payment succeeds.

5. Acceptable use

You agree not to:

  • Use the Service for spam, phishing, malware, scraping abuse, or unauthorized access
  • Generate or publish illegal content, including content that infringes others’ IP, promotes fraud, or violates advertising or financial laws
  • Post fake reviews, fabricated testimonials, or deceptive endorsements
  • Misuse trademarks, brand names, or logos of third parties on generated sites in a confusing or infringing way
  • Remove or hide required affiliate disclosures, or publish affiliate content without clear disclosure where required (including FTC Endorsement Guides and network rules)
  • Claim guaranteed earnings, “passive income,” or “autopilot money” as typical results when using or marketing sites built with the Service
  • Reverse engineer, overload, or disrupt the Service except as allowed by law
  • Resell or white-label the Service without our written permission
  • Use the Service if you are prohibited under U.S. or other applicable sanctions/export rules

We may remove content, suspend publishing features, or terminate accounts for violations.

6. AI-generated content — your responsibility

The Service uses AI and automation to draft sites, articles, recommendations, and creatives.

  • You must review all AI output before publishing or relying on it. AI can be wrong, outdated, biased, or incomplete.
  • You are solely responsible for accuracy, disclosures, claims, SEO practices, and compliance of content you publish.
  • Results vary. We do not guarantee traffic, rankings, affiliate approvals, clicks, conversions, or commissions.
  • Output is not financial, investment, tax, or legal advice.
  • You own your original inputs. Subject to these Terms and third-party rights, we grant you a license to use generated drafts for your legitimate affiliate marketing. We do not use your content to train AI models. We may use anonymized or aggregated usage patterns to improve the Service.
  • Third-party product names and trademarks remain with their owners.

7. Affiliate networks and third-party services

You must open and operate your own publisher accounts with affiliate networks. Network approval, policies, and commissions are between you and those networks. We are not responsible for network suspensions, commission denials, API outages, or Amazon/Creators API qualification rules.

Stripe, Google, Base44, and affiliate networks have their own terms. Your use of those services is also subject to those terms.

8. Intellectual property

The Affiliateking AI name, logos, UI, and software are owned by us or our licensors. You may not copy the product, scrape the Service, or use our brand in a way that suggests endorsement without permission.

You retain rights in content you upload. You grant us a limited license to host, process, display, and transmit that content as needed to provide the Service (including generating and publishing sites you request).

9. Disclaimer of warranties (“as is”)

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUT WILL BE ACCURATE OR PROFITABLE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FREEDOM EMPOWERING CAPITAL MANAGEMENT LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON AI OUTPUT.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED.

11. Indemnity

You will defend and indemnify us against claims arising from: (a) content you generate or publish using the Service; (b) your affiliate marketing practices or network account conduct; (c) your violation of these Terms or law; or (d) your misuse of third-party trademarks or personal data.

12. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate access for violation of these Terms, nonpayment, legal risk, or discontinuation of the Service. Sections that by nature should survive (including IP, disclaimers, liability limits, indemnity, and governing law) survive termination.

13. Governing law

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law rules. Courts located in Colorado have exclusive jurisdiction over disputes, except where prohibited by law.

14. Changes to these Terms

We may update these Terms. We will update the “Last updated” date and may notify you of material changes. Continued use after changes become effective constitutes acceptance where permitted by law.
